GENERAL CONDITIONS

І. SUBJECT
Art. 1. These terms and conditions are intended to govern the relationship between Foxini, part of the “Sybon” Ltd., UIC 205060665, with registered office and registered address in. Sofia, p.k. 1517, Poduyane district, g.k. “Sukhata reka” 91, entrance no. B, et. 3, app. 26 , hereinafter referred to as “SUPPLIER”, and the customers, hereinafter referred to as “USERS”, of the e-shop www.foxyni.com, hereinafter referred to as “e-shop”.

III. FEATURES OF THE E-SHOP
Art. 3. The e-shop is available at the following Internet address: www.foxyni.com , through which Users have the possibility to:
- To register and create an account to view the Online Shop and use the additional services for providing information;
- To place orders for the goods published on the Supplier’s website;
- To enter into contracts for the purchase and delivery of the goods offered by the Online Shop;
- To make electronic statements in connection with the conclusion or performance of contracts with the e-shop, through the interface of the shop page, available on the Internet;
- To make any payments in connection with the contracts concluded with the Online Shop, according to the payment methods provided;
- To receive information about new products offered by the e-shop;
- To review the goods, their characteristics, prices and delivery terms;
- To be informed of the rights arising from the law primarily through the interface of the e-shop website;
- To exercise the right of withdrawal from the contract concluded at a distance for the goods offered by Sybon Ltd., for which the right of withdrawal is applicable.
Art. 4. The Supplier shall deliver the goods and guarantee the rights of the Users provided for by law, within the framework of good faith and the criteria and conditions accepted in practice, in consumer and commercial law.
Art. 5. (1) Users place orders (i.e. conclude a contract of sale) for the goods offered by the Online Shop and available at www.foxyni.com.
(2) By virtue of the contract concluded with the Users for the purchase and sale of goods, the Supplier undertakes to deliver and transfer the ownership of the goods specified by the User through the e-shop.
(3) Users shall pay to the Supplier the remuneration for the delivered goods, according to the terms set out on the E-shop page and these General Terms and Conditions. The remuneration is the price announced by the Supplier on the address of the Internet shop – www.foxyni.com.
(4) The Supplier shall deliver the goods ordered by the Users within the terms and conditions set by him on the e-shop page and in accordance with these General Terms and Conditions.
(5) The price for delivery shall be determined separately from the price of the goods.
Art. 6. (1) The User and the Provider agree that all statements between them in connection with the conclusion and performance of the Purchase and Sale Agreement may be made electronically and by electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Article 11 of the Electronic Commerce Act.
(2) It is assumed that the electronic statements made by Users on the site are made by the persons indicated in the data provided by the User at registration, if the User has entered the appropriate username and password.
IV. USE OF THE E-SHOP
Art. 7. (1) In order to use the E-shop to conclude contracts for the purchase and sale of goods, the User shall enter a remote access name and password.
(2) The name and password for remote access are determined by the User, through electronic registration on the Provider’s website www.foxyni.com. During registration, the User must enter a first and last name, a valid email address and a telephone number.
(3) By filling in his/her details and clicking the “Register” button, the User declares that he/she is familiar with these General Terms and Conditions, agrees with their content and undertakes to unconditionally comply with them.
(4) The Provider confirms the registration made by the User by sending a letter to the e-mail address specified by the User, to which information is sent about the data declared by the latter. Simultaneously with the confirmation, the User’s account is created and a contractual relationship is established between the User and the Provider.
(5) Upon registration, the User undertakes to provide correct and up-to-date data. The User shall promptly update the details provided in his registration in the event of a change.
(6) In the event that the User uses the possibility of collecting his/her profile created in web social networks (Google, Facebook) for registration, the party to the contract is the person who is the owner of the profile used for registration in the respective social or other network. In this case, the Provider has the right to access the data necessary to identify the User in the relevant social or other network.
V. TECHNICAL STEPS FOR CONCLUDING A PURCHASE CONTRACT
Art. 8. (1) Users primarily use the interface of the Supplier’s website to conclude contracts for the purchase and sale of the goods offered by the Supplier in the Online Store.
(2) The contract shall be concluded in Bulgarian.
(3) The contract between the Provider and the User is these General Terms and Conditions, available at www.foxyni.com.
(4) Party to the contract with the Provider is the User, according to the data provided at registration and contained in the personal profile of the User. For the avoidance of doubt, these are the details with which an account has been created with the Supplier.
(5) The supplier shall include in the interface of its website technical means for detecting and correcting errors in the input of information before the statement of conclusion of the contract is made.
(6) This contract shall be deemed to have been concluded from the moment of acceptance of the General Terms and Conditions upon registration of the User on the Provider’s website. The contract for the purchase and sale of goods shall be deemed to be concluded from the moment of ordering by the User through the electronic store of the Supplier.
(7) For the conclusion of this contract and the conclusion of the contract for the purchase and sale of goods, the Supplier shall expressly notify the User in an appropriate manner by electronic means. The confirmation shall also state the delivery date of the goods. The supplier is entitled to set a different delivery period for each contract. In case of inability to deliver the ordered goods, the Supplier shall inform the User within 2 days from the date of dispatch of the order.
(8) The statement of conclusion of the contract and the acknowledgement of its receipt shall be deemed to have been received when their addressees are able to access them.
(9) The Supplier shall deliver the goods to the address indicated by the Users and shall not be liable in case the data indicated by the Users are false or misleading.
Art. 9. Users shall conclude the Purchase and Sale Agreement with the Supplier according to the following procedure:
(1) Registration in the Online Shop, confirmation of acceptance of the terms and conditions and provision of the necessary data if the User has not registered in the Online Shop;
(2) Login to the system to place orders in the Online Store by identifying with a name and password;
(3) Selecting one or more of the goods offered on www.foxyni.com and adding them to a list of goods for purchase;
(4) Provision of data for making the delivery;
Art.10 For the purchased goods the user shall pay the price announced on the site. The Supplier reserves the right to introduce a limitation in the quantity of products ordered, with regard to the price, and to announce a different price when purchasing a certain quantity of a product. The user shall pay the price by cash on delivery to the courier who delivered the goods subject to the concluded purchase contract or by bank transfer.
